Total Casino is an internet casino that operates legally in Poland. It does so under the state monopoly written into the Gambling Act of 19 November 2009 (ustawa o grach hazardowych). The site is run by Totalizator Sportowy sp. z o.o. — the same State Treasury company that runs the Lotto lottery. The casino launched in December 2018, a little over a year after the amendment that created a state monopoly on online casino games.

Who runs Total Casino, and under what authority

Under article 5 of the Gambling Act, running casino games over the internet in Poland is reserved for a state monopoly. That monopoly is exercised by Totalizator Sportowy, a single-shareholder State Treasury company. In practice this means a foreign licence — from Malta, Curaçao or Anjouan — does not give a company the right to run an online casino aimed at players in Poland.

For a player, three consequences follow:

• Domestic supervision. The operator answers to the Ministry of Finance and the National Revenue Administration, and consumer disputes are settled under Polish law — in Polish courts, in the country where you live.
• The tax is handled for you. The flat-rate tax on winnings is withheld by the operator as the paying agent, so you do not declare it in your annual return.
• No risk of a domain block. totalcasino.pl will not be added to the Ministry of Finance register of domains used to offer gambling in breach of the Act, because it complies with that Act.

Registration and identity checks

A licensed casino in Poland cannot accept an anonymous player. The Gambling Act and anti-money-laundering rules both require identity to be confirmed, which is why signing up at Total Casino looks nothing like signing up at an offshore site.

1. You open an account with your personal details, including your PESEL number (the Polish national identification number — foreign residents receive one when they register a residence address) and the details of an ID document, either a national ID card or a passport.
2. You confirm you are of age. The limit is 18, with no exceptions.
3. You go through verification: the operator checks that the data matches and, in some cases, asks for a scan of the document or confirmation of your bank account.
4. The account is activated and you set your responsible-gambling limits.

Tax on winnings: 10 % above PLN 2,280

Gambling winnings are exempt from tax up to PLN 2,280 under art. 21(1)(6a) of the Personal Income Tax Act. Above that threshold a flat 10 % income tax applies. At Total Casino the operator withholds it as paying agent: you receive the net amount and do not report it in your PIT return.
